Welcome to PocketTavern. These Terms of Use (the “Terms”) are a legal agreement between you and the operator of PocketTavern (“we”, “us”) covering the website, Web client, iOS app, Android app, and related services (the “Service”). By accessing, registering for, signing in to, or using the Service, you confirm that you have read and agree to these Terms and the Privacy Policy. If you do not agree, stop using the Service.
The Service is intended for individuals who can enter into a binding contract. If you are under 18, you may use the Service only with a parent or guardian’s consent. We do not provide the Service to children under 13 (or the higher age required where you live).
Please read carefully: Section 6 (Content policy and AI labelling), Section 11 (Acceptable use), Section 16 (Disclaimers), Section 17 (Limitation of liability), Section 18 (Indemnity), and Section 20 (Governing law and disputes) materially affect your rights and obligations and are highlighted below. Read them before accepting.
1. Definitions
- You means the person who accesses or uses the Service.
- Account means the identity created via email one-time code, Sign in with Apple, or Google.
- Creative assets means character cards, World Info, Personas, presets, and files derived from import, creation, or generation.
- Chat data means messages, session settings, and history (including imported JSONL).
- Official models means third-party language models we expose and bill in points.
- Custom API means an endpoint and key you configure; traffic does not use our official-model pipe.
- Points are in-Service units used to pay for official-model calls. They are not legal tender and are not transferable.
- Pro is the paid plan. Today it increases the daily point grant and unlocks AI character generation and Custom API.
- AIGC / AI output means text, character cards, or other artefacts generated by the Service or by models you call through the Service.
2. The Service
PocketTavern is a multi-device roleplay client that reads and writes common SillyTavern file formats. The Service currently includes:
- creating, editing, importing, and exporting character cards (PNG / JSON, common v1 / v2 layouts);
- managing, importing, and exporting World Info, Personas, and presets (JSON);
- text chat with a character (including emoji) and per-session model, preset, Persona, and World Info selection;
- official-model access and a point balance;
- for Pro: one-tap AI character generation and Custom API;
- the Web client, iOS app, and Android app as entry points on the same account.
We are not the SillyTavern project and are not affiliated with, endorsed by, or partners of SillyTavern. Compatibility means support for common community card, lorebook, preset, and JSONL chat files. It does not include the desktop extension or plugin ecosystem, or group chats.
This version does not include a community marketplace, a content feed, group chat, or plugins. Nothing in the Service is an endorsement of any model vendor, card author, or SillyTavern.
3. Accounts
You may create and use an account with an email one-time code, Sign in with Apple, or Google. Keep your credentials and devices secure. Losses from shared accounts, leaked codes, or an unlocked device are yours.
One person should use one account. We may limit login, freeze points, or close an account that is clearly automated, bulk-created, or abusive.
You may request deletion. After you submit the request there is a 30-day cooling-off period during which you may cancel. When it ends, we delete account profile data, subscription state, and sync data under our control within a further 15 days. Records required by law (tax records, abuse logs) are destroyed or anonymised once their statutory retention period ends. Creative assets and chats that remain only on a device must be exported by you first or they may be unrecoverable.
4. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service under these Terms. Except as mandatory law allows, you may not copy, modify, reverse engineer, rent, or resell the client, APIs, or documentation, or remove notices.
Free and Pro users may create and import unlimited characters, World Info, Personas, and custom presets. Feature differences are those shown in the app and on the pricing page at the time of use. We may adjust plan benefits with reasonable notice. Points already granted in a paid period are not clawed back for that reason.
5. Your content
You retain whatever rights you have in creative assets and chat data. You grant us a limited licence to process them only as needed to run the Service: storing account metadata, transmitting creative assets when you use sync, forwarding official-model requests to providers, and handling diagnostics you send us.
You represent that you have the right to import, create, or generate the content; that it does not infringe others’ IP, privacy, or other rights; and that it complies with the law where you live and with the terms of any model you connect to.
Chat data and creative assets are stored on your device by default. We do not train our own models on your chats or cards, and we do not use them for advertising. When you use an official model, prompts, context, and completions are processed under that provider’s terms. See the Privacy Policy.
An optional on-device PIN only controls local access. It is not an account-recovery method and we cannot unlock data on a device you no longer control.
6. Content policy and AI labelling
This is a core section on content boundaries and compliance obligations. Please read carefully.
6.1 Prohibited content
Whether you use official models or Custom API, you must not use the Service to create, generate, transmit, export, or distribute:
- sexual, sexualised, or suggestive material involving anyone under 18 (or a higher age where you live), or any depiction of exploitation, grooming, or violence against minors;
- non-consensual sexual acts, rape, incest, bestiality, or paedophilic content;
- sexual, sexualised, deepfake, defamatory, or harassing content targeting an identifiable real person (including public figures);
- content that incites or gives detailed instructions for self-harm, suicide, terrorism, mass violence, weapons of mass destruction, hazardous chemicals, or drug manufacture;
- content that promotes extreme national, racial, religious, gender-based, or ethnic hatred, or crimes against humanity;
- content that infringes another person’s IP, trade secrets, privacy, personal information, or other rights;
- anything unlawful under the laws of the place where you use the Service (including, for users in mainland China, laws on cybersecurity, data security, personal information, and generative AI services).
The Service permits adult-oriented roleplay when you have deliberately opted in, provided the content stays on your device for private use, does not cross the lines above, and you are of legal adult age where you live. Any onward distribution of NSFW content, public sharing, or commercial use of it is at your sole legal risk.
6.2 Official models and Custom API
Official models are bound by each vendor’s content policy and may refuse a prompt, return a warning, or degrade output. Point spend follows the vendor’s metering. Custom API calls settle directly between you and the provider under its terms; disputes over content moderation, suspensions, or refunds are between you and that provider.
6.3 AI labelling
AI-generated artefacts (for example characters made with one-tap generation) carry an “AI generated” or equivalent label in the app and preserve a label field in exported metadata. If you distribute AIGC in mainland China, you must comply with the Interim Measures for the Management of Generative AI Services and keep or add the required label, and you remain responsible for the truthfulness and legality of the content.
6.4 Enforcement
If we find, or receive a credible report, that data you have uploaded to our servers (account records, evidence in a complaint, creative assets when sync is on, AI-generation ledgers) breaches this Section, we may restrict access, delete the data, suspend or close the account, and report the matter to authorities. We cannot and will not moderate on-device chats or cards that never leave your device.
7. Models, points and billing
Official-model calls spend points based on usage. Cost varies by model and by prompt and completion length; the app shows a reference range. Points come from the daily login grant (10 per day on Standard, 30 per day on Pro) and other grants we publish. The Service does not sell point top-ups.
Points are virtual units: they cannot be exchanged for money, change, or gifts, and cannot be used outside the Service, and they are not a cryptocurrency or token of any kind. Granted points do not expire until spent. Cancelling Pro does not wipe points already received. After account deletion completes, unused points are cancelled without refund.
Unless we say otherwise, prices displayed are inclusive of applicable tax as charged by Apple, Google, or a payment processor we designate.
We do not warrant that any third-party model will be available, accurate, or safe. Outputs may be wrong or offensive. You decide whether to rely on them.
8. Pro subscription
Pro is a recurring paid plan (monthly or yearly as shown at purchase). Current benefits are: 30 points per daily login, AI character generation, and Custom API. Character, World Info, Persona, and preset limits, and SillyTavern-compatible import/export, are the same on Free and Pro.
Fees are charged by the App Store or Google Play. Renewal, cancellation, and refunds follow that store’s rules. Turn off auto-renew in the store before the period ends if you do not want another charge.
AI character generation is Pro-only. Outputs remain your content under Sections 5 and 6. Failed or unwanted generations, or extra point spend where disclosed, are not a breach by us.
9. Bring Your Own Key
Custom API is a Pro feature. Keys and base URLs stay in on-device secure storage. We do not upload or host your keys. Custom API traffic is billed by your provider and does not spend points.
You must have the right to use the key and must follow that provider’s terms (including local Ollama, OpenAI-compatible proxies, Anthropic, and Gemini). The Web client may need CORS configuration to reach a local host. Custom reverse proxies, Azure, and Cloudflare Workers-style gateways may require manual fields we cannot fully validate.
If your device is compromised or you leak a key, disputes are between you and your model provider under its terms; we owe no refund, reimbursement, or stop-payment.
10. Import, export and compatibility
You may import character cards, World Info, presets, Personas, and standard JSONL chats. Import is a read-only copy. We never open or change a SillyTavern folder on your desktop. Duplicate names receive a copy suffix; existing items are not overwritten.
We aim to support common formats. We do not guarantee every third-party file, corrupt file, undocumented extension field, or group-chat log will import. Group chats are not supported and may be skipped.
You may export creative assets in the same family of formats. Exports are plain files; use your own encryption or a trusted channel when transferring or storing them. You are responsible for exported files.
11. Acceptable use
In addition to Section 6, you must not:
- use the Service for illegal activity, fraud, harassment, gambling promotion, money laundering, or anything unlawful where you live;
- attempt unauthorised access to our systems, other accounts, or the official-model pipe;
- bypass point metering, subscription checks, or interface limits, or farm daily grants with automation;
- submit other people’s personal data or trade secrets to a model without authority;
- use the Service in ways the connected model vendor forbids;
- attack, scrape, or overload the Service, or distribute malware;
- imply that PocketTavern is official SillyTavern software, or misuse our name or marks;
- use the Service for, or on behalf of, any party subject to sanctions or export controls that apply to you.
We may limit features, delete server-side data, or close an account if we find a violation or receive a valid complaint, and we may report matters to authorities.
12. Complaints and takedown
If you believe content in the Service infringes your rights (including cards shared with you, or assets uploaded to our servers via sync), send a takedown notice to abuse@pockettavern.com containing:
- your identity and contact information;
- proof of the right you claim (copyright registration, trademark number, ID, or authorisation);
- enough detail to locate the content (card name, author, import id, public link, etc.);
- the specific action you ask us to take;
- a good-faith statement and acknowledgement that a false claim can create liability.
We reply within 5 business days of a valid notice and, where appropriate, limit access to or remove the server-side data. A user we act against may send a counter-notice. We will forward it to the notifier and act as the law directs. False or bad-faith notices are at the notifier’s cost.
For account suspensions or feature limits, you can request human review through the same address. We normally respond within 10 business days.
13. Intellectual property
The PocketTavern name, marks, UI, code, copy, and documentation (other than your content) belong to us or our licensors. Use of the Service transfers no ownership.
Copyright in imported third-party cards, lorebooks, or presets stays with the original rights holders. Format compatibility does not widen the licence those authors granted you.
Rights you may claim over AI outputs generated from your prompts are governed by the law where you live. We take no position and do not warrant any such rights, but you remain responsible under Sections 5 and 6.
14. Third parties
The Service relies on or may open: model vendors, Apple, Google, email delivery, app stores, and any Custom API endpoint you set. Their terms apply separately. Outages, filters, moderation outcomes, or price changes at a third party are not our breach. When we change or add an official model vendor we will note it in the changelog or on this site.
15. Changes and interruptions
We may change features, the model list, point rates, or plan descriptions, and we will note material updates in the changelog or in-app. Maintenance, security work, or events beyond our control may interrupt the Service. Except where mandatory law says otherwise, we are not liable for reasonable changes or downtime on free features or virtual units.
16. Disclaimers
Please read carefully: this Section disclaims implied warranties.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED OR ERROR-FREE OPERATION, AND SECURITY. Model output is machine-generated text that may be wrong, biased, offensive, or unlawful; it is not professional advice (legal, medical, financial, or psychological) and does not speak for us. You are responsible for how you use or share it.
17. Limitation of liability
Please read carefully: this Section limits the scope and cap of our liability.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages, or lost profits or data. Our total liability to you is capped at the amount you paid us for the relevant paid features in the twelve (12) months before the claim; if you only used free features, the cap is zero, except for liability that cannot be limited (such as death or personal injury caused by our wilful misconduct or gross negligence).
18. Indemnity
You will indemnify us against reasonable legal fees, settlements, and direct losses arising from your breach of these Terms, your infringement of third-party rights, or your unlawful use of the Service.
19. Termination
You may stop using the Service and request deletion at any time. We may suspend or close an account for material breach, unlawful use, or to protect the Service. On termination the licence ends. Sections that by nature should survive (Sections 5, 6, 11, 13, 16, 17, 18, 20 and the General section) survive.
20. Governing law and disputes
These Terms are governed by the laws of the People’s Republic of China (excluding conflict-of-law rules and rules of the Hong Kong SAR, Macau SAR, and Taiwan). The parties will first try to resolve disputes informally; failing that, the courts at our domicile have jurisdiction. If you purchased through Apple or Google, you also have that store’s complaint and refund routes. Mandatory consumer protections in your country of residence still apply and are not waived by this Section.
21. Changes to these Terms
When we update these Terms we will change the date and version at the top of this page. Material changes (for example to liability scope, dispute resolution, or paid features) are notified in-app or by email at least 7 days before they take effect. Continued use after that is acceptance. If you do not agree, stop using the Service and request deletion before the effective date.
22. General
- Feedback: suggestions, bug reports, or feature requests you send are voluntary. We may use them, without payment, on a non-exclusive, worldwide basis, to improve the Service. They are not your personal information or your intellectual property under these Terms.
- Force majeure: we are not liable for delay or non-performance caused by war, government action, natural disaster, utility failure, telecom failure, DDoS, upstream model outages, or similar events beyond our reasonable control.
- Severability: if a provision is held invalid or unenforceable, the rest remain in force and that provision is replaced by the closest valid alternative permitted by law.
- No waiver: our failure or delay to exercise a right is not a waiver, and a single waiver is not a waiver of the right for the future.
- Assignment: you may not assign rights or obligations under these Terms; we may assign them to an affiliate, or in connection with a merger, acquisition, or corporate reorganisation, with notice to you.
- Notices: notices from us are effective when sent via in-app message, the email tied to your account, or a notice on this site. You may reach us at the addresses in Section 23.
- Sanctions and export: you confirm you do not live in, and do not use the Service on behalf of any party on, the U.S. OFAC SDN List or an EU or UN sanctions list.
- Entire agreement: these Terms, together with the Privacy Policy and any app-store terms you accepted, are the complete agreement between you and us for the Service and supersede earlier oral or written communications.
